CONTRACT OF SALE
To purchase goods from the mybrand.ie website you must be 18 years of age or over. By submitting your order you are offering to buy the goods at the price set out in the order and allowing us to use your personal details for the purposes of supplying goods (including passing your details on to couriers and other subcontractors etc). We will not use your details for other purposes without asking your consent and you may ask that your details be removed from our system by writing to the address at the bottom of our website. Our delivery charges are set out on our website with the products to which they apply and are based on An Posts prices. We must receive payment of the whole of the price for the goods that you order before your order can be accepted. Once payment has been received by us we will confirm that your order has been accepted by sending an email to you at the email address you provide in your order form. Our acceptance of your order brings into existence a legally binding contract between us. Prices are checked regularly. However, if we find the price has changed when we receive your order we will contact you and ask if you wish to proceed. .
ORDERS
You will be sent an automated order confirmation email if your order has been successful. This email will contain order details and a transaction reference number (ID). When you receive an email confirmation of order from us, this is to indicate that we have received your order. It does not indicate that a contract exists between us. We will indicate acceptance of your order, and hence a contract between us, when we send you an invoice. We have included this term to protect us in the case that a mistake has been made in pricing, we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason. In the case of a change of price, we will always contact you first to ensure that the price is acceptable.
mybrand.ie reserves the right to decline orders for bulk or high value purchases.
We may also refuse to accept an order:
(a) where goods are not available;
(b) where we cannot obtain authorisation for your payment;
(c) if there has been a pricing or product description error; or
(d) if you do not meet any eligibility criteria set out in our terms and conditions.
We retain the right to cancel any order at any time. If payment has been made, we will provide a full refund immediately.
DELIVERY
We will deliver the goods ordered by you to the address you give us for delivery at the time you make your order. We will aim to dispatch all orders placed before 3pm on the day of the order (Monday to Friday), orders placed at the weekend will be packed and delivered on the Monday thereafter. These delivery conditions apply to Ireland only, if you have an outside of Ireland enquiry, please email us for your country’s time frame and postage cost. You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.
DESCRIPTIONS & PRICES
Prices on this website are in Euro, Prices are subject to alteration by my brand without prior notice.We do our utmost to keep all prices and information on this web site up to date. However, occasionally information from our suppliers can change at short notice, so we must reserve the right to alter specifications and prices on the web site at short notice. In the rare event that the price of an item ordered through the on-line shop has changed we shall endeavour to hold to the price shown at the time of ordering. However, in cases where there is a substantial increase we shall contact you to agree a new price before accepting payment. If you do not wish to agree to the new price then we reserve the right to withdraw from the transaction.
We will not be held responsible for pricing errors due to software mal-functions, or human error.
Mistakes can occasionally occur with descriptions or prices quoted on our website or in email or phone quotations. We reserve the right to correct these and will always inform you before proceeding with your order. We are not bound to the price quoted at time of ordering until you have received both the goods and an invoice.
WARRANTY AND RETURNS POLICY
We do offer a 10 day money back guarantee if you are not 100% totally satisfied. The 10 day period starts from the date you receive your order. A refund will only be issued on return of the items, unopened and in original packaging, and in the condition they were sent out in.Within those 10 days of purchase we will refund the purchase price subject to €4.99 to cover our admin costs. Any faulty items that you may receive can be returned to us for replacement within this time frame also. Please be advised that we send out all our goods in good faith so if a problem does arise they we will be happy to do whatever is necessary to sort the issue.
PERSONS UNDER THE AGE OF 18
You must be eighteen (18) years of age, and possess a valid credit card / Laser Card / Mastercard to purchase our products. Mybrand.ie will not sell products to minors.You must register your details with us to confirm that you are of the age of 18 or over. We reserve the right to cancel any sales transaction based on our sole discretion where we believe the purchaser is purchasing products on behalf of a minor. By purchasing from us you declare that you are aged over 18 years on the date of purchase.
ELECTRONIC COMMUNICATIONS
When you visit the mybrand.ie website or send e-mails to us, you are communicating with us electronically. We communicate with you by e-mail or by posting notices on the website. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
EVENTS / SITUATIONS BEYOND OUR REASONABLE CONTROL
mybrand.ie or the mybrand company will not be held responsible in any way for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control.
